This website (the "Site") is operated by 4 Miller Boys, LLC DBA WASH BINS (hereinafter, "WASH BINS"), a California limited liability company ("Company," "we," "us," or "our"). The following terms and conditions (together with any documents referred to in them) (collectively, these "Terms") apply to your use of our website or other services offered at the Site, by WASH BINS or through any mobile application we develop utilizing the tools from the website (collectively, our "System").

Your use of our Site and/or System means that you accept and agree to these Terms. If you do not agree to these Terms, or our PRIVACY POLICY, do not use or access the System. By signing up for or using our services, you ("Client," "you," or "your") agree to be bound by these Terms.

PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE SITE AND/OR THE SYSTEM, AS THEY AFFECT YOUR LEGAL RIGHTS. THESE TERMS CONTAIN A BINDING ARBITRATION AGREEMENT WHICH LIMITS YOUR RIGHTS TO BRING AN ACTION IN COURT, BRING A CLASS ACTION, AND HAVE DISPUTES DECIDED BY A JUDGE OR JURY, AS WELL AS PROVISIONS THAT LIMIT OUR LIABILITY TO YOU.

BY ACCESSING THIS SITE, YOU REPRESENT THAT YOU HAVE READ, UNDERSTOOD AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO ANY OF THESE TERMS, YOU MAY NOT USE THIS SITE.

Use of the System.

  1. License. On the condition that you comply with all your obligations under these Terms, WASH BINS grants you a limited, personal, revocable, nonexclusive, non-assignable, non-sublicensable license and right to access the System. Any other use of the System is strictly prohibited, and a violation of these Terms. WASH BINS reserves all rights not expressly granted in these Terms, including, without limitation, rights of title, ownership, intellectual property, and all other rights and interests in the System, and all related items, including without limitation, all rights in the System as a collective work.
  2. Revision of these Terms. We may revise these Terms from time to time. WASH BINS will use reasonable efforts to notify you of such changes. Such efforts might include posting notice on the Site, the System, an email to the address we have on file for you, or another method. However, please check the "Last Updated" legend at the top of this page to see when these Terms were last revised. Such revised Terms will be effective upon the "Effective Date" stated above. You should revisit these Terms on a regular basis, as revised versions will be binding upon you. You understand and agree that your continued access to or use of the Services after the effective date of changes to these Terms indicates your acceptance of such revisions.
  3. Access to the System. We reserve the right to delete or amend the System and any service or material we provide on the System, in our sole discretion, without notice or liability. We will not be liable if for any reason all or any part of the System is unavailable at any time or for any period. From time to time, we may restrict access to some parts of the System or the entire System.
  4. Intellectual Property and Use Restrictions.
    1. Intellectual Property & Contact. WASH BINS Trash Bin Cleaning Service and the associated logo are registered trademarks of 4 Miller Boys, LLC. All content and materials are Copyright © 2019-2026. All rights reserved.
    2. As a condition of your use of the System, you warrant that you will not use the System for any purpose that is unlawful or prohibited by these Terms. You may not use the System in any manner which could damage, disable, overburden, or impair the System, or interfere with any other party's use and enjoyment of the System. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the System. All content included as part of the System, such as text, graphics, logos, images, as well as the compilation thereof, and any software used on the System, is our property or the property of our suppliers and protected by copyright and other laws that protect intellectual property and proprietary rights. You agree to observe and abide by all copyright and other proprietary notices, legends, or other restrictions contained in any such content, and will not make any changes thereto. You will not modify, publish, transmit, reverse engineer, participate in the transfer or sale, create derivative works, or in any way exploit any of the content, in whole or in part, found on the System. Our content is not for resale. Your use of the System does not entitle you to make any unauthorized use of any protected content, and in particular you will not delete or alter any proprietary rights or attribution notices in any content. You will use protected content solely for your personal use and will make no other use of the content without our express written permission. You agree that you do not acquire any ownership rights in any protected content. We do not grant you any licenses, express or implied, to our intellectual property or our licensors, except as expressly authorized by these Terms.
  5. Service Expectations & Results. WASH BINS aims to provide the best results with each service. However, receptacles (bins or dumpsters), trash chutes, enclosures, and power washing areas that are extremely soiled may require multiple treatments to achieve optimal cleanliness. Our odor control services are designed to significantly reduce unpleasant smells, but results may vary based on the age and condition of the equipment, the specific area, and frequency of service. For the most effective results, we strongly recommend sanitizing your equipment or area on a regular basis per a scheduled recurrence.
    1. Receptacle, Chute, Enclosure & Area Identification
      1. No Rotating Units or Areas: Only the specific bins, dumpsters, trash chutes, enclosures, or area identified during your initial sign-up will be serviced. Rotating units, locations, or areas is strictly prohibited.
      2. Adding Units or Areas: To add a new bin, dumpster, trash chute, enclosure, area, or odor control service to your account, please contact us via phone, email, or text. Your account and billing will be updated accordingly.
    2. Scheduling, Access & Client Responsibility
      1. Accessibility: Receptacles, trash chutes, enclosures, and areas must be curbside, visibly accessible, or located in a pre-arranged spot on the scheduled service date.
      2. Empty Windows: It is the client's responsibility to leave receptacles empty for the following windows:
      3. Residential Bins: Must remain empty and accessible from 7AM to 7 PM on the scheduled service date.
      4. Dumpsters & Enclosures: Must remain empty for a four-hour window immediately following your provided trash collection time.
      5. Chute & Area Access: For trash chute, power washing or odor control services, the Client must ensure all necessary access points (intake doors, enclosures, or designated areas) are accessible to our technicians and that the area is not in use during the scheduled service window.
      6. Residential Safety: Our technicians will not knock on doors or enter areas behind locked or closed gates for safety and liability reasons.
      7. Commercial/HOA Access: For commercial properties, gated access will only be used if access points (gate codes, contact personnel, etc.) are provided in advance.
      8. Empty Requirement: Receptacles, dumpsters, trash chutes, and enclosures must be completely empty. We do not haul or remove trash. If a unit or area contains significant waste, we will not service it, and a rescheduling fee may apply.
      9. Availability: We do not service on Sundays or major holidays.
    3. Communications: Email & Text Reminders. As a courtesy, we send email reminders the day before service and text reminders the morning of service.
      1. Consent: By providing your phone number, you consent to receive service-related text messages from WASH BINS.
      2. Rates: Standard message and data rates may apply.
      3. Opt-Out: You may opt-out of text communications at any time by replying "STOP" to any message.
    4. Health & Safety Restrictions
      1. WASH BINS will not service any receptacle, trash chute, enclosure, or area containing:
      2. Un-bagged human or animal waste.
      3. Hazardous waste, chemicals, wet paint, cooking oils, or motor oils.
      4. Active animal infestations (e.g., mice, rats, raccoons, snakes, bears, etc.).
    5. Rescheduling & Fees
      1. Notice Period: You must contact us at least 24 hours prior to your scheduled service to reschedule.
      2. Rescheduling Fees: If we arrive and cannot perform service due to lack of access or failure to notify us of a change, a rescheduling fee of $10.00 will apply for residential and $25.00 for commercial clients.
    6. Billing & Cancellations
      1. Payment Cycles: Initial payment is processed on the day of sign-up. Subsequent payments are processed on the 1st of the month in which service is scheduled.
      2. Early Cancellation/Reduction: Applies only to bins and dumpsters. If you cancel service, reduce units, or switch units before your second scheduled service, you will be charged a minimum service fee equivalent to our One-Time Service Rate.
    7. Force Majeure: Services delayed by weather or state of emergency will be rescheduled for the next available date. Clients will be notified via email and text.
  6. Promotions: Next Day Service Guarantee. Offer valid for first-time residential cleanings only for sign-ups received by 4:00 PM PST. WASH BINS reserves the right to modify or discontinue this promotion at any time. If the guaranteed service does not occur, the service will be refunded and the service will be rescheduled.
  7. Limitation of Liability & Indemnification. TO THE FULLEST EXTENT PERMITTED BY CALIFORNIA LAW, WASH BINS, its members, officers, employees, contractors, its subsidiaries and affiliates SHALL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL LOSS OR DAMAGE OF ANY KIND ARISING OUT OF OR RELATED TO THIS AGREEMENT OR THE USE OR INABILITY TO USE THE SITES, ANY SITE CONTENT OR DOWNLOADED CONTENT, INCLUDING WITHOUT LIMITATION, LOST BUSINESS OR PROFITS, WHETHER ARISING IN TORT (INCLUDING NEGLIGENCE), EQUITY, BREACH OF CONTRACT, OR OTHERWISE (AND WHETHER OR NOT SUCH DAMAGES ARE FORESEEABLE OR WASH BINS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGE). RELEASEES ALSO SHALL NOT HAVE ANY LIABILITY OR RESPONSIBILITY FOR ANY ACTS, OMISSIONS OR CONDUCT OF ANY SITES USER OR OTHER THIRD PARTY. TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT WILL THE COLLECTIVE LIABILITY OF THE RELEASEES EXCEED ONE HUNDRED DOLLARS ($100.00 USD), REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT, OR OTHERWISE. IF APPLICABLE LAW LIMITS THE APPLICATION OF THE FOREGOING LIMITATION OF LIABILITY, WASH BINS'S LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
  8. Dispute Resolution and Arbitration; Class Action Waiver; Jury Trial Waiver.

    PLEASE READ THIS SECTION CAREFULLY - IT MAY SIGNIFICANTLY AFFECT YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT OR TO PURSUE CLAIMS IN A CLASS OR REPRESENTATIVE CAPACITY. THIS SECTION APPLIES ONLY WHERE PERMITTED BY APPLICABLE LAW.

    1. ARBITRATION USES A NEUTRAL ARBITRATOR INSTEAD OF A JUDGE OR JURY, ALLOWS FOR MORE LIMITED DISCOVERY THAN IN COURT, AND IS SUBJECT TO VERY LIMITED REVIEW BY COURTS. YOU MAY CHOOSE TO BE REPRESENTED BY A LAWYER IN ARBITRATION OR PROCEED WITHOUT ONE. THIS ARBITRATION PROVISION SHALL SURVIVE TERMINATION OF THIS AGREEMENT. IF, HOWEVER, EITHER THE CLASS ACTION WAIVER OR COORDINATED CLAIMS PROVISION BELOW ARE FOUND INVALID, THEN THE SPECIFIC INVALID PROVISION WILL BE UNENFORCEABLE AND WILL BE SEVERED AND THE REMAINDER OF THE ARBITRATION PROVISIONS WILL REMAIN IN FULL FORCE.
    2. You and we agree that any dispute, claim or controversy, including those known or unknown that may be later discovered, arising out of or relating to this Agreement, or other agreements on the Services, or our Privacy Policy or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be either determined by binding arbitration before one arbitrator or submitted to small claims court. Any arbitration arising out of or related to this Agreement shall be conducted in accordance with the expedited procedures set forth in the JAMS Comprehensive Arbitration Rules and Procedures as those Rules exist on the effective date of this Agreement, including Rules 16.1 and 16.2 of those Rules.
    3. YOU AGREE THAT ANY CLAIMS OR ARBITRATION UNDER THIS AGREEMENT WILL TAKE PLACE ON AN INDIVIDUAL BASIS; YOU AND WE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR OUR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING; CLASS ARBITRATIONS AND CLASS ACTIONS ARE NOT PERMITTED AND YOU ARE AGREEING TO GIVE UP THE ABILITY TO PARTICIPATE IN A CLASS ARBITRATION OR CLASS ACTION. Further, unless both you and we agree otherwise, the arbitrator may not consolidate more than one person's claims with your claims and may not otherwise preside over any form of a representative or class proceeding. If this specific provision is found to be unenforceable, then the entirety of this arbitration provision shall be null and void. The arbitrator may award declaratory or injunctive relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party's individual claim.
    4. If you elect to seek arbitration or file a small claim court action, you must first send to us, by email to the address in Section 12(d) below a written notice of your claim ("Notice"). The Notice to us must be addressed to: [email protected]. If we initiate arbitration, we will send a written Notice to an email address you have previously provided to us, if available. A Notice, whether sent by you or by us, must (i) describe the nature and basis of the claim or dispute; and (ii) set forth the specific relief sought ("Demand"). If you and we do not reach an agreement to resolve the claim within thirty (30) days after the Notice is received, you or we may commence an arbitration proceeding or file a claim in small claims court.     5. Notwithstanding the foregoing, you and we both agree that you or we may sue in court to enjoin infringement or other misuse of intellectual property rights or in other scenarios where injunctive relief is appropriate. In the event a court or arbitrator having jurisdiction finds any portion of this Agreement unenforceable, that portion shall not be effective, and the remainder of the Agreement shall remain effective. No waiver, express or implied, by either party of any breach of or default under this Agreement will constitute a continuing waiver of such breach or default or be deemed to be a waiver of any preceding or subsequent breach or default.
    6. You and we shall maintain the confidential nature of the arbitration proceeding and any award granted in connection with the same, including the hearing, except as may be necessary to prepare for or conduct the arbitration hearing on the merits, or except as may be necessary in connection with a court application for a preliminary remedy, a judicial challenge to an award or its enforcement, or unless otherwise required by law or judicial decision.
  9. Property & Equipment: We are not responsible for damage to receptacles, trash chutes, or enclosures, that are aged, brittle, or have pre-existing cracks or structural issues. We are not liable for damage to property except to the extent caused by our gross negligence or willful misconduct.
  10. Miscellaneous.
    1. Nothing in these Terms limits any non-waivable rights under California law.
    2. Headings/Interpretation. Headings are for convenience only and do not affect interpretation.
    3. Governing Law & Venue. These Terms shall be governed by the laws of the State of California. To the extent a dispute is not subject to arbitration, any legal proceedings shall be instituted exclusively in the state or federal courts located in Los Angeles County, California.
    4. No Assignment. These Terms, and any rights or obligations under these Terms, are not assignable, transferable or sublicensable by you except with WASH BINS' prior written consent but may be assigned or transferred by WASH BINS without restriction. Any attempted assignment by you shall violate these Terms and be void and unenforceable.
    5. Beneficiaries. Nothing in these Terms is intended to, nor will it be deemed to, confer rights or remedies upon any third party.
    6. Term and Termination. These Terms remain in force so long as user continues to access or use the System or until terminated by any party. WASH BINS may terminate this Agreement for any reason at any time and users may terminate by discontinuing all of WASH BINS's services. WASH BINS reserves the right, in its sole discretion, to suspend or terminate users' access to or use of the System at any time if WASH BINS believes users have acted in violation of these Terms, WASH BINS's Privacy Policy, or applicable law, or have attempted to interfere with the System, or have acted with intent to annoy, abuse, threaten, or harass any other person. Upon termination, users' access to the System will cease.
    7. Third-Party Services. If you use a service, feature, or functionality that is operated by a third party and made available through our System, each party's terms will govern the respective party's relationship with you. WASH BINS is not responsible or liable for a third party's terms or actions taken under the third party's terms.
    8. Reliance on Information Posted. The information presented on or through the System is made available solely for general information purposes. We do not warrant the accuracy, completeness, or usefulness of this information. Any reliance you place on such information is strictly at your own risk. We disclaim all liability and responsibility arising from any reliance placed on such materials by you or any other visitor to or user of the System, or by anyone who may be informed of any of its contents.
    9. Links to Other Websites and Connecting through Social Media. The System may contain hyperlinks to websites operated by third parties. We do not control such websites and will not be responsible for their content, or for any breach of contract, or any intentional or negligent action on the part of such third parties, which results in any loss, damage, delay, or injury to you or your companions. Inclusion of any linked website or social media icon on the System does not imply or constitute approval or endorsement of the linked website by us. If you decide to leave the System to access these third-party sites, you do so at your own risk. All rules, policies (including privacy policies), and operating procedures of websites operated by third parties will apply to you while on such sites. We are not responsible for information provided by you to third parties.
    10. Electronic Communications. Visiting the Site, using the System, submitting forms, or sending emails to us constitutes electronic communications. You consent to receive electronic communications, and you agree that all agreements, notices, disclosures, and other communications that we provide to you electronically, via email, and on the System, satisfy any legal requirement that such communications be in writing. To opt out of receiving marketing emails from us, follow the "unsubscribe" link on the email to change your user preferences.
    11. Entire Agreement. These Terms of Use, together with our Privacy Policy are the entire agreement between you and us related to your use of the System. No waiver of these Terms by us shall be deemed a further or continuing waiver of such term or condition or any other term or condition, and any failure by us to assert a right or provision under these Terms of Use shall not constitute a waiver of such right or provision.
    12. Severability. If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.
